1.2 Automatically Collected Information

When you visit our Website, certain information is collected automatically, including:

  • Usage Data: IP addresses, browser type and version, pages visited, time and date of visits, and referring URLs.
  • Cookies and Tracking Technologies: We use cookies and similar technologies to improve your experience on the Website. See Section 8 for more detail.

2. Lawful Basis for Processing Your Data

Under the Kenya Data Protection Act, 2019, WITIA processes your personal data on the following lawful bases:

  • Consent: Where you have given us clear, express, and informed consent, for example when subscribing to our newsletter or registering for an event and agreeing to receive marketing communications.
  • Contract: Where processing is necessary to fulfil a membership agreement or event registration you have entered into with us.
  • Legal Obligation: Where we are required to process your data to comply with applicable Kenyan law.
  • Legitimate Interests: Where processing is necessary for our legitimate interests as an NGO, such as improving our Website and programmes, provided those interests are not overridden by your rights and freedoms.

3. How We Use Your Information

We use the personal information we collect for the following purposes:

  • To provide, operate, and maintain the Website and our programmes.
  • To process event registrations and membership applications.
  • To communicate with you about your account, registration, or enquiry.
  • To send you updates, newsletters, and information about WITIA events, opportunities, and programmes, where you have consented to receive such communications.
  • To use event registration data for marketing purposes, including informing you of future WITIA activities aligned with our mission, where you have consented to this at the point of registration.
  • To use event registration data for reporting and accountability purposes, including donor reporting, impact assessments, and communications with our partners and funders. Data used for reporting may be aggregated or anonymised where appropriate.
  • To improve our Website, services, and user experience.
  • To comply with applicable legal obligations.

4. Event Registration Data

When you register for any WITIA event, including workshops, hackathons, summits, training programmes, or community meetups, you acknowledge that we collect and process your registration data in the following ways:

4.1 What We Collect at Registration

Depending on the event, we may collect your name, email address, phone number, organisation, job title, professional background, and any other information you provide on the registration form.

4.2 Marketing Communications

By registering for a WITIA event, you consent to WITIA using your contact details to inform you of future events, programmes, partnerships, and opportunities that align with our mission. This consent is given expressly and voluntarily at the point of registration, as required by the Kenya Data Protection Act, 2019.

You may withdraw this consent at any time by contacting us at info@witia.africa or by using the unsubscribe link in any marketing email we send you. Withdrawal does not affect the lawfulness of any processing carried out before you withdrew consent.

4.3 Reporting and Accountability

Your event registration data may also be used for internal and external reporting purposes, including donor reporting, impact assessments, programme evaluations, and communications with WITIA partners and funders. Where data is used in reports or shared with third parties for these purposes, it will be aggregated or anonymised wherever possible to protect your identity.

4.4 Photography, Video, and Media

WITIA events may be photographed or recorded for documentation, social media, and reporting purposes. By attending an event, you acknowledge that your image or voice may be captured. Where practicable, we will notify attendees at the start of an event if recording or photography will take place. If you do not wish to appear in photos or recordings, please inform a WITIA representative at the event or contact us in advance at info@witia.africa.

4.5 Data Retention for Events

We retain event registration data for as long as is necessary to fulfil the purposes described above, including ongoing reporting obligations to funders. Where data is no longer needed, it will be securely deleted or anonymised. You may request deletion of your data at any time by contacting us, subject to any legal obligations we may have to retain it.

5. Sharing Your Information

WITIA does not sell, trade, or rent your personal data to third parties. We may share your information only in the following limited circumstances:

  • Service Providers: Trusted third-party vendors who assist us in operating our Website, processing payments, or delivering our programmes (such as hosting providers and email platforms). These providers are contractually required to handle your data securely and only for the purposes we specify.
  • Partners and Funders: Where event or programme data is shared for reporting purposes, this will be done in aggregated or anonymised form wherever possible.
  • Legal Authorities: Where we are required to disclose your information by Kenyan law, court order, or government authority.

6. International Data Transfers

Some of our service providers may be located outside Kenya. Where your personal data is transferred outside Kenya, we take steps to ensure that adequate safeguards are in place in accordance with the Kenya Data Protection Act, 2019, which restricts cross-border transfers unless the receiving country provides adequate data protection or you have given your explicit consent.

7. Data Security

WITIA implements appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. We will notify the Office of the Data Protection Commissioner (ODPC) and affected individuals of any data breach that poses a risk to your rights, as required by law.
